Terms of Use for GeoMACE Application

Welcome to GeoMACE! By accessing or using the GeoMACE application (“GeoMACE,” “App,” “we,” “our,” or “us”), owned and operated by MACE Qatar Contracting and Engineering Company W.L.L. (“MACE Qatar”), you agree to be bound by these Terms of Use (“Terms”). Please read them carefully. If you do not agree with these Terms, you may not use the App.

1. Acceptance of Terms

  • By accessing or using GeoMACE, you agree to be bound by these Terms, our Privacy Policy, and any additional terms that may apply to specific features or functions of the App.

  • We may update these Terms from time to time. Changes will be effective immediately upon posting. Continued use of the App after changes have been made constitutes your acceptance of the revised Terms.

  • GeoMACE displays and utilizes data from governmental sources. While we strive to provide accurate and up-to-date information, MACE Qatar does not guarantee the accuracy, completeness, or reliability of government data.

  • No Responsibility for Inaccuracies: MACE Qatar is not responsible or liable for any inaccuracies or errors in the government data presented on the App. Users acknowledge that government data may change or be updated without notice.

4. Restrictions

  • You may not use GeoMACE for any purpose that is illegal or prohibited by these Terms.

  • You agree not to:

  • Violate or attempt to violate any security features of the App.

  • Access or attempt to access another user’s account without authorization.

  • Use the App in a manner that could disrupt, damage, or negatively impact our services or networks.

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.

  • Use any automated system, including robots or scrapers, to access the App.

5. License and Intellectual Property

  • License: Subject to these Terms, MACE Qatar grants you a limited, non-exclusive, non-transferable license to use the App for its intended purposes.

  • Ownership: All content and materials available on the App, including but not limited to text, graphics, software, and logos, are the property of MACE Qatar and are protected by copyright, trademark, and other intellectual property laws.

  • Restrictions on Use: You may not reproduce, distribute, modify, or create derivative works from the content on the App without prior written permission from MACE Qatar.

6. Third-Party Services

  • GeoMACE may integrate with or link to third-party services or resources, such as weather data providers and GIS platforms. These third-party services are not under our control, and we are not responsible for their content or practices.

  • Your use of third-party services is governed by the terms and conditions of those services.

7. Data and Privacy

  • Data Collection: We collect and process data as described in our Privacy Policy. By using GeoMACE, you consent to our data practices, including the collection, use, and disclosure of your information.

  • Data Security: We take reasonable measures to protect your data but cannot guarantee the security of your information. You acknowledge that there are risks inherent in using the App, including the potential for unauthorized access or data breaches.

8. Disclaimers and Limitation of Liability

  • No Warranty: The App is provided on an “AS IS” and “AS AVAILABLE” basis. MACE Qatar makes no warranties or representations about the accuracy or completeness of the App’s content or the availability of the App.

  • Limitation of Liability: To the maximum extent permitted by law, MACE Qatar will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

  • Force Majeure: MACE Qatar will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of war, or internet service provider failures.

9. Indemnification

  • You agree to indemnify, defend, and hold harmless MACE Qatar, its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, or expenses, including reasonable attorney’s fees, arising out of your use of the App, violation of these Terms, or infringement of any intellectual property or other rights.

10. Governing Law and Dispute Resolution

  • These Terms are governed by and construed in accordance with the laws of Qatar, without regard to conflict of law principles.

  • Dispute Resolution: Any disputes arising from or related to these Terms or the use of the App will be resolved through binding arbitration in Qatar or through small claims court if eligible.

11. Termination

  • MACE Qatar reserves the right to suspend or terminate your access to the App at any time, with or without notice, for violating these Terms or for any other reason at our sole discretion.

  • Upon termination, the licenses and rights granted to you under these Terms will cease immediately.

12. Miscellaneous

  • Entire Agreement: These Terms, along with the Privacy Policy, constitute the entire agreement between you and MACE Qatar and supersede any prior agreements.

  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

  • No Waiver: MACE Qatar’s failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
